Report: Paris Hilton Is Free!
Web Site Reports That Heiress Made Her Exit Early This Morning

CBS/AP) Paris Hilton has been released from jail after serving three days, TMZ.com reports.

The Los Angeles County Sheriff's Department called a hastily scheduled news conference early Thursday morning outside the Century Regional Detention Facility to answer reporters' questions about the famous inmate.

TMZ.com reported that sources it didn't name said Hilton left the jail early Thursday morning.

The sheriff's department inmate locator Web site did not have any information, still saying early Thursday that her projected release is June 26.

Hilton checked into the facility Sunday night to begin serving a more than three-week sentence for violating probation in an alcohol-related reckless driving case.

The 26-year-old hotel heiress surrendered to authorities with little fanfare after a surprise appearance earlier that day at the MTV Movie Awards, where she worked the red carpet in a strapless designer gown.

She was held in a special unit where she was spending 23 hours a day in a solitary cell, her lawyer said.

After she checked in, sheriff's spokesman Steve Whitmore said Hilton's demeanor was helpful.

"She was focused; she was cooperative," he said.

Hilton's lawyer, Richard Hutton, said Monday after his client's first night in jail that she was doing well under the circumstances.

The star of "The Simple Life" reality TV show pleaded no contest to a reckless-driving charge in January and was sentenced to 36 months' probation. When she was later pulled over by the California Highway Patrol, Hilton was told that she was driving on a suspended license and signed a document acknowledging she was not to drive. She was then pulled over by sheriff's deputies on Feb. 27 and charged with violating probation.

They will claim the jail was overcrowded and needed the space for more violent offender. Are you really that surprised? I didn't think she would do this much time. If it were you or me, we would still be sitting there counting the days.

BUT, on to more info straight from CNN!!!!!!!!!!

LOS ANGELES, California (CNN) -- Paris Hilton was let out of jail Thursday morning, days after she began serving what was to have been a 45-day sentence for violating probation, a spokesman for the Los Angeles County Sheriff's Department said.
Hilton must wear a monitoring bracelet and remain at her home for another 40 days, said sheriff's department spokesman Steve Whitmore.
Medical considerations "played a part" in the decision to offer Hilton home confinement for the remainder of her sentence, Whitmore said. (Watch Whitmore detail Hilton's deal )
He said privacy rules prohibited him from giving details about the medical issues, but celebrity Web site TMZ.com earlier quoted sources saying Hilton was refusing to eat much of the jail food served her.
Whitmore said that after "extensive consultation with medical personnel" it was decided to offer Hilton "reassignment" to home confinement, which she and her attorneys accepted. (Watch Hilton enter jail )
Part of the deal was that her original sentence of 45 days, which had been reduced to 23 days if she showed good behavior behind bars, would be restored to the full length. Although she reported to the jail just before midnight Sunday and departed in the early hours of Thursday, she was given credit for five days, he said.
Whitmore said the decision to send Hilton home was made by a panel of officials in the sheriff's department, although the judge who sentenced her was advised of the move.
Hilton was arrested on charges of drunken driving in September.
In January, she pleaded no contest to a charge of alcohol-related reckless driving. She was sentenced to three years' probation and had her license suspended.
In February, she was caught driving on a suspended license, which later was ruled a probation violation.
Hilton entered jail Sunday after attending the MTV Movie Awards, where she answered questions from the press and was the subject of host Sarah Silverman's jokes.

I am surprised that she spent as much as one hour in jail. And I am surprised it took this long to find some reason to get her out.

Prosecutors Want Sheriff's Department Held Under Contempt; Hilton Ordered to Court
Hilton Leaves House Arrest for Court Date'

Print Paris Hilton is under house arrest, but she is not home free.

Prosecutors are seeking to hold the sheriff's department, that runs the Century Regional Detention Facility, in contempt for releasing Hilton early from jail. The heiress was ordered to court at 9 a.m. in Los Angeles.

"We cannot tolerate a two-tiered jail system where the rich and powerful receive special treatment," said Los Angeles City Attorney Rocky Delgadillo, the prosecutor on the case.

Delgadillo is questioning why Hilton's "medical condition" wasn't treated at the detention facility, which has a medical staff and an infirmary.

Not only this, but the Superior Court Judge Michael Sauer, who sentenced Hilton, wrote in court documents that Hilton was not allowed to substitute a lesser punishment for time in jail.

Sauer explicitly wrote, "No work furlough. No work release. No electronic monitoring."

According to Allan Parachini, the public informations officer for the L.A. Superior Court told ABC, "Early release decisions are the province of the sheriff every day due to jail overcrowding but not always. In this particular manner Judge Sauer was advised yesterday afternoon of the sheriff's intention to release her and his response was that he reaffirmed the terms of the sentence on May 4th."

And yet, Hilton was "reassigned" to her multi-million dollar home in Hollywood Hills.


Party On?
There she is required to wear a monitored ankle bracelet for 40 days. The ankle bracelet has a range of 3,000 to 4,000 square feet.


Under the terms of her house arrest, Hilton can stroll outside, get the mail and maybe even throw a party if she wants, said Bob Taylor of the the Los Angeles County Probation Department.

Any trip beyond her home would require the permission of the Probation Department.


Taylor said that while normally those under house arrest with a 9-to-5 job are allowed to go to work, it is very unlikely the socialite would be given permission to attend a party or an event for which she would be paid.


But she may not be that isolated. Taylor said Hilton can invite guests over and even throw a party and sip cocktails, because nobody would monitor who is in her home or how she behaves.

Hilton was sentenced to prison for violating probation in an alcohol-related reckless driving case, and was released from jail for medical reasons.


"With the help of medical personnel and doctors, it was determined that she be reassigned to a community-based electronic monitoring program," said Steven Whitmore, the sheriff's department spokesman.

If she leaves her home while on house arrest, Whitmore said, she will most likely be remanded to court, and her jail time would be bumped up to 90 days. Hilton's sentence was initially shortened from 45 days to 23 days, because of state rules allowing shorter sentences for good behavior.

"Because she has agreed to this through her attorney, her sentence is now back up to 45 days. She has already served five days, so that's 40 days," Whitmore said.

Through her attorney, Paris Hilton issued a written statement thanking the Los Angeles County Sheriff's Department for treating her fairly. The statement went on to say, "I have learned a great deal from this ordeal and hope that others have learned from my mistakes."



The Ankle Bracelet Club
Hilton is not the only celebrity who has been assigned an ankle bracelet. Last month, a Los Angeles judge ordered former "Saturday Night Live" star Tracy Morgan to wear the bracelet for 90 days for violating probation for a drunken driving arrest. Morgan wore the bracelet while he hosted Spike TV's Guys Choice Awards.

"Lost" star Michelle Rodriguez turned the ankle bracelet into a fashion statement when she wore it to New York Fashion Week in February. Rodriguez was sentenced to 60 days in jail for violating probation after a drunken driving arrest in Hawaii. She was released from the Century Regional Detention Center -- where Hilton also was serving her time -- almost immediately because of overcrowding.

And then there's Martha Stewart. Stewart was convicted in March 2004 on four counts of lying to investigators and obstructing justice after selling her shares in the pharmaceutical company ImClone days before its application for a new drug was denied. She served five months before she was placed under supervised release and required to wear an ankle bracelet for an additional five months.


Was She Cut a Break?
When one reporter asked if Hilton had been cut a break, Whitmore said, "It's a fair statement, and I don't know if there's any way to address that. … [We're] fully aware of this criticism and this action was taken."

There was a story on CNN that said this would be good for her in the long run, but not in the way the judge intended. The longer she stays in jail, the more money she will make from interviews, books, maybe a movie. That is probably why she told her lawyers to not appeal the sentence.

Plus she will now have a bit of notoriety from being a convicted criminal. Since she will never have to work for a living, that won't be a problem.
